General Terms and Conditions (GTC)

Scope of Application
These General Terms and Conditions apply to all orders placed by consumers (Section 13 of the German Civil Code, BGB) via the online shop of Blechdeckel GmbH.
Any differing terms and conditions of the customer shall not be recognized unless we expressly agree to their validity in writing.

Offer and Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the “Buy Now” button, you submit a binding offer to conclude a purchase contract.
The contract is concluded as soon as we accept the order by sending an order confirmation via email or by dispatching the goods.

Prices and Shipping Costs
All prices are stated in euros and include the applicable statutory value-added tax.
Shipping costs are charged in addition.
Shipping costs are calculated based on weight and depend on the total weight of the order as well as the selected shipping method (parcel delivery or freight forwarding).
The applicable shipping costs are displayed transparently in the shopping cart and before completion of the order.

Delivery
Delivery is currently available exclusively within mainland Germany to the delivery address provided by the customer. Deliveries to German islands are excluded.
Shipping is carried out depending on the weight of the order:

Parcel Delivery
Shipments with a product weight of up to 28 kg are sent by parcel service.

Freight Forwarding
Shipments with a product weight of more than 28 kg, as well as bulky goods, are shipped by freight forwarder.

Unless otherwise agreed, delivery is made curbside.
For freight deliveries, the commissioned freight company will arrange a delivery appointment by telephone in advance (pre-notification).

We do not keep all products in stock at all times. It may therefore occur that individual products are manufactured after the order is placed.
Unless otherwise stated, the delivery time is 3–10 business days.

Payment Terms
Payment shall be made using the payment methods offered during the ordering process (e.g. PayPal, credit card, Klarna invoice).
The purchase price is due upon conclusion of the contract.
In the event of late payment, we reserve the right to withhold delivery.

Retention of Title
The goods remain our property until full payment has been made.

Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal.
Details of the right of withdrawal can be found in the separate withdrawal policy on our website.

Return and Return Costs
In the event of withdrawal, the goods must be returned to us without undue delay and no later than within 14 days.
The customer shall bear the costs of return shipping.
This applies in particular to goods suitable for freight forwarding (e.g. fire bowls, fire baskets, grill stations).

Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
goods manufactured according to individual customer specifications

individually customized or personalized products

Warranty
The statutory warranty rights shall apply.
Material-typical properties of steel (e.g. patina, initial rusting, color changes caused by heat or weathering) shall not constitute a defect, provided that the functionality is not impaired.

Liability
We shall be liable without limitation in cases of intent and gross negligence, as well as in the event of injury to life, body, or health.
In the case of slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.
Otherwise, liability is excluded to the extent permitted by law.

Use and Safety
Our products are intended exclusively for their designated use in outdoor areas.
Safety, care, and usage instructions must be observed at all times.
We accept no liability for damage caused by improper use.

Voluntary Guarantee
In addition to the statutory warranty rights, Blechdeckel GmbH grants a voluntary guarantee on material and workmanship for certain products (hereinafter referred to as the “Steel Guarantee”).

(1) Scope of the Guarantee
The voluntary Steel Guarantee applies to all steel products of Blechdeckel GmbH, in particular fire pits, fire baskets, and grills, and covers:

material defects in the steel used

workmanship and welding defects

the structural stability under proper use

(2) Guarantee Period
The guarantee period is 5 years from the date of purchase, unless otherwise stated in the respective product description.

(3) Conditions
A prerequisite for claiming the guarantee is the proper use of the product in accordance with the intended conditions of use, as well as compliance with any care and safety instructions.

(4) Exclusions from the Guarantee
The guarantee does not cover in particular:

natural changes in the material such as patina, rust formation, or color changes resulting from heat, fire, or weather

signs of wear resulting from intended use over a longer period and which do not constitute a material or workmanship defect

damage caused by improper use, incorrect operation, modifications, misuse, or external influences

(5) Relationship to Statutory Warranty Rights
The voluntary guarantee applies in addition to the statutory warranty rights.
These rights are neither limited nor replaced by the guarantee.

Online Dispute Resolution
Pursuant to Section 36 VSBG, we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
